Everything a Startup Needs to Know About IP

Entrepreneurs know they should protect their intellectual property (IP) to appeal to prospective investors, partners, customers, and employees. This panel of IP professionals will discuss trademarks, patents, and trade secrets with a focus on how startups often go wrong and how to avoid major IP pitfalls while protecting IP assets, valuation, and credibility. There are many pitfalls for the unwary in the field of intellectual property that most entrepreneurs are unaware of as they start their entrepreneurial journey.
Even if you think you know what you need to about intellectual property, it is always helpful to hear how IP professionals answer questions such as: Is trademark searching an expensive minefield when done wrong or at the wrong time? When should inventors search for prior art if at all? Are trade secrets at risk if employment agreements, confidentiality agreements, and supplier and customer contracts are not carefully constructed? What is the best use of non-disclosure agreements and of non-compete agreements and of non-solicitation agreements? When should a startup have inventors assign their IP to the company?
This meeting’s presentations and discussion will cover the importance of IP to various people and aspects of startup companies, including, founders, investors, inventors, engineering, product development, and marketing. Especially, this meeting will cover the types of errors related to IP that startup companies make and how to avoid them.
A question-and-answer session will follow the panel discussion, and the panelists will be available afterward for responses to individual questions.

Jeffrey J. Barclay

Wiseman Law which serves emerging and commercial organizations in Greater Boston. Previously, Tyler worked with and managed world-class IP outside counsel, as Chief Legal & Compliance Officer for Elevar Therapeutics, Inc., a commercializing oncology biotech. Prior to his time at Elevar, Tyler worked at Praxis Precision Medicines, Inc., a public, clinical-stage biotech, as the right-hand man to the general counsel, working with and managing the patent and trademark prosecution portfolios. In his roles managing biotech patent and trademark portfolios, Tyler has rolled up his sleeves to work tirelessly with outside counsel to manage IP dockets while constantly attempting to innovate and evergreen the IP portfolios. Beyond IP matters, Tyler has extensive experience navigating transactional matters, employment matters and pre-litigation and litigation matters.
Previously, Tyler worked in Vertex Pharmaceuticals’ Legal Department and in support staff roles in WilmerHale’s and Ropes and Gray’s intellectual property departments.
